1. INTRODUCTION

Joey Klein LLC (“Joey Klein,” “we,” “us,” or “our”) provides personal development training, programs, and related offerings through: (a) our websites, including joeyklein.com and any other websites (collectively, the “Site”) that link to this Privacy Policy; (b) our mobile application(s); and (c) our online and offline interactions with you in connection with our offerings (for example, email, text, telephone, Zoom, and in-person events) (collectively, with the Site and mobile applications, the “Services”). This Privacy Policy (“Policy”) describes how Joey Klein collects, uses, discloses, and otherwise processes information obtained through your use of the Services, and explains your choices regarding our data practices.

This Privacy Policy applies to all visitors and users of the Services, regardless of whether you have purchased a Joey Klein product or event. Please read this Policy carefully. By accessing or using the Services, you acknowledge that you have read and understood this Privacy Policy. Where required by applicable law, we will obtain your separate consent before processing sensitive personal information.

2. INFORMATION WE COLLECT

The types of information we collect about you depend on how you interact with us and on our Services. In this section, we describe the categories of information we collect, organized by how we obtain it. If you do not provide your information when requested, you may not be able to use our Services or certain features of our Services if that information is necessary to provide them to you.

A. Personal Data

We collect information by which you may be personally identified, such as your name, postal address, phone number, and email address. You may provide this information when creating an account on the Site or our mobile application, completing a form (online or in person), registering for a program or event, or otherwise interacting with our Services.

B. Assessment Data

If you take an assessment or survey through the Services, we collect your responses and results, which may include personality or archetype classifications, behavioral categories, demographic details, and other scoring metrics we generate about you. Some of this information may be considered sensitive personal information under applicable law, and where required, we will obtain your consent before collecting or processing such data.

C. Demographic Data

We collect demographic information you provide, such as your age, gender, location, occupation, and other similar identifying characteristics.

D. Communications Data

We collect information contained in your communications with us, including when you request information about our Services, provide feedback, complete a form, or contact our support services. This may include your contact details, the date and time of your communication, and the content of your messages, which may include information relating to emotional or psychological patterns or wellbeing topics.

E. Login Data

If you create an account on the Site or our mobile application, we collect information related to your account, such as your username (which is your email address) and password.

F. Transaction Data

We collect information related to your transactions with us, such as the type of product or service requested or provided, order details, subscription terms, event details (if applicable), and the amount charged. Payment processing is handled by a third-party payment processor. We do not have direct access to, process, transmit, handle, or store your credit or debit card details. Transaction records may also be maintained in our customer relationship management platform and on our other service platforms in connection with providing our Services to you.

G. Inferences

In addition to the categories described above, we may, with your consent where required by applicable law, draw inferences about you based on the information we collect, including your responses to assessments, surveys, or interactive tools on the Site, to create a profile reflecting your preferences, characteristics, psychological trends, predispositions, behavior, attitudes, abilities, or aptitudes, including information relating to emotional or psychological patterns or wellbeing topics. 3. HOW WE COLLECT YOUR INFORMATION

We collect the categories of information described in Section 2 through the following methods. Depending on how you interact with our Services, we may collect information directly from you, automatically through tracking technologies, or from other sources.

A. Directly from You

You may provide information directly to us when you create an account on the Site or our mobile application, complete a form (online or in person), register for a program or event, contact our support services, make a purchase, or otherwise interact with our Services. The categories of information you may provide directly include the Personal Data, Demographic Data, Communications Data, Login Data, and Transaction Data described in Section 2 above.

B. Cookies and Tracking Technologies

As you navigate through and interact with our Services, our service providers, and other third parties may use automatic tracking technologies to collect certain data about your equipment and browsing actions (such as your IP address, device identifiers, pages visited, time spent on pages, cursor movement, session recordings (which do not capture keystrokes in password or payment fields), and interaction data). The automatic tracking technologies we may use include the following:

  • Cookies (or browser cookies). A cookie is a small file placed on the hard drive of your computer. You may refuse to accept browser cookies by activating the appropriate settings on your browser. However, if you select this setting, you may be unable to access certain parts of the Site. Unless you have adjusted your browser setting so that it will refuse cookies, or you have declined non-essential cookies via our cookie consent banner (where available), our system may issue cookies when you direct your browser to the Site.
  • Log Files. Log files are software-generated files containing data about the operations, activities, and usage patterns of an application, server, or IT system, such as what was done and at what time. Like most websites, our servers automatically keep logs of visits, which include the visitor's IP address and the pages they access. We use these for security and to keep the Site running properly.
  • SDKs. A Software Development Kit or "SDK" represents a consolidated package of pre-existing code, enhancement tools, and guidance documents that can be installed and used to develop applications for a particular digital asset. SDKs enable our partners to collect certain data from the Site in accordance with our agreements with those partners. The data collected has numerous applications, including offering us insightful analytics about the Site's usage, enabling social media incorporation, introducing new attributes or capabilities to the Site, or assisting in tracking and enhancing the efficacy of our online advertisements.
  • Web Beacons. Pages of the Site may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit us, for example, to count users who have visited those pages or for other related Site statistics (for example, recording the popularity of certain Site content and verifying system and server integrity).

C. Information from Other Sources

Joey Klein may receive information about you from other sources, such as publicly available databases, social media platforms (if you interact with us through social media), or business partners. Any such information will be used in accordance with this Policy and the terms under which the information was collected.

4. HOW WE USE YOUR INFORMATION

Joey Klein uses your information collected through the Services for the following purposes, as necessary to perform our contract with you, to pursue our legitimate business interests, with your consent, or as otherwise required or permitted by applicable law:

  • To provide, operate, and maintain the Services
  • To create and manage your account, if you choose to register on the Site or our mobile application
  • To respond to your comments, questions, and requests, and provide customer service and support
  • To analyze and understand how visitors to our Site engage with our content and programs
  • To improve the functionality, design, and user experience of the Services
  • To develop new Joey Klein programs, products, and services
  • To conduct internal research and performance analysis
  • To draw inferences about you based on the information we collect, including your responses to assessments, surveys, or interactive tools on the Site
  • To fulfill any other purpose for which you voluntarily provide information
  • To send you marketing communications, such as newsletters and promotional content, where you have opted in to receive such communications
  • To deliver targeted advertisements or other content that may be of interest to you based on your interactions with our Services
  • To comply with applicable legal obligations, such as responding to subpoenas or other lawful requests for information
  • To detect, investigate, and prevent fraudulent transactions and other illegal activities and protect the rights and property of Joey Klein and others

We also aggregate or de-identify information and use it as permitted by law, including but not limited to enhancing and personalizing your experience with us, for promotional purposes, to test our IT systems, for research, data analysis, to improve our Services, to develop new products and features, to license or sell aggregated and de-identified datasets or derived insights to third-party research organizations, analytics and advertising providers, marketing partners, or service providers (as further described in Section 5), subject to contractual restrictions prohibiting re-identification, to develop and commercialize Joey Klein products, tools, or services, and for other purposes consistent with applicable law. We will maintain aggregated or de-identified data in a form that cannot reasonably be used to infer information about, or otherwise be linked to, a particular individual. We will not attempt to re-identify such data.

5. WHO WE SHARE YOUR INFORMATION WITH

We may disclose your information to the following categories of third parties for the purposes set forth below.

A. Service Providers

We share information with third-party service providers who perform services on our behalf, such as website hosting, data analytics, payment processing, email delivery, marketing, and customer service. These service providers have contractual obligations to use the information only for the purposes of providing services to us and to maintain appropriate security measures to protect your information.

B. Analytics and Advertising Providers

We engage third parties to provide analytics services regarding the Services, such as assisting us in estimating our audience size and usage patterns by tracking certain data through cookies and similar tracking technologies. We also engage third parties to serve advertisements and perform related services across the web and in mobile applications. These entities may use automatic tracking technologies to collect data about your use of the Services and other third-party digital assets, including your IP address and other identifiers, pages viewed, time spent on pages, links clicked, and conversion data. These third parties may use this data to deliver advertisements that are more relevant to you, to analyze and track data, determine the popularity of certain content, and better understand your online activity.

C. Business Transfers

We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business by another company. If such a transaction occurs, we will use reasonable efforts to direct the acquiring company to use your information in a manner consistent with this Privacy Policy.

E. Professional Advisors

We may disclose your information to professional advisors, such as lawyers, bankers, auditors, and insurers, where necessary in the course of the professional services that they render to us.

F. Your Consent or at Your Direction

We may disclose your information to third parties when we have your consent or direction to do so.

6. DATA RETENTION

We retain your data for as long as reasonably necessary to provide you with our Services and to fulfill the purposes described in this Policy, but in no event longer than is permitted by applicable law. We periodically review our data holdings and delete or de-identify Personal Data that is no longer necessary for the purposes for which it was collected. In addition, we may retain this data if necessary to comply with our legal obligations, resolve disputes, or enforce our agreements.

When we process Personal Data, we determine the retention period taking into account various criteria, such as the type of services provided to you, the nature and length of our relationship with you, the impact on our services if we delete some data from or about you, and mandatory retention periods provided by law.

7. YOUR CHOICES

  • Marketing Communications. If you opt in to receive marketing communications when creating your account, you may receive periodic emails from Joey Klein, including “The Connection Fix” newsletter and other promotional content. You may opt out by clicking the “unsubscribe” link included in each marketing email, or by contacting us at admin@innermatrixsystems.com. After you unsubscribe, you may continue to receive product or service-related and other non-marketing emails. If you have provided more than one email address to us, you may continue to be contacted unless you request to unsubscribe each email address you have provided.
  • Text Messages. If you consent to receive text messages from us, you may opt out at any time by replying “STOP” to any text message we send you or by contacting us at admin@innermatrixsystems.com.
  • Account Data. If you have created an account on the Site or our mobile application, you may update or correct your account information by logging into your account settings. You may also delete certain data directly through our mobile application. If you wish to delete data maintained in our customer relationship management platform, or if you have other questions about the personal information we hold about you, please contact us at admin@innermatrixsystems.com.
  • Tracking Technologies. You may manage or disable certain tracking technologies through your browser settings at any time. Most browsers allow you to view what cookies are stored on your device, block all or certain types of cookies, and delete cookies already stored on your device. On certain parts of the Site, you may also manage cookie preferences via a consent banner allowing you to accept or decline non-essential cookies.
  • Targeted Advertising. We work with certain Analytics and Advertising Providers, as described in Section 5 (Who We Share Your Information With). These providers may use this data to provide you with interest-based (behavioral) advertising, including retargeting based on your prior interactions with our Services and lookalike-audience advertising built from our contact lists. While we use reasonable efforts to implement and maintain contractual requirements with these providers regarding data use, we do not have direct control over their tracking technologies. Because this activity may constitute a “sale” or “sharing” of personal information under applicable state privacy laws, you may opt out as described in this section or by contacting us at admin@innermatrixsystems.com. Some of our Analytics and Advertising Providers may be members of the Network Advertising Initiative (“NAI”) or subject to the Self-Regulatory Principles for Online Behavioral Advertising published by the Digital Advertising Alliance (“DAA”). You can obtain more information about these companies’ practices and opt out of interest-based advertising from participating NAI and DAA members at the NAI’s website (optout.networkadvertising.org) or the DAA’s website (optout.aboutads.info). Your mobile device settings may also allow you to limit ad tracking using your device’s advertising identifier. If you opt out, you will still see advertisements, but they may be less relevant to you. We use reasonable efforts to require that our Analytics and Advertising Providers honor applicable opt-out requests. You may also contact us at admin@innermatrixsystems.com to opt out of our use of your information for targeted advertising.

Please note that disabling certain tracking technologies may affect the functionality of the Site. Essential tracking technologies cannot be disabled without impairing core Site functions. Even if you opt out of marketing communications, we may still send you non-promotional messages, such as those about your account or our ongoing business relations.

The Services also use Google Analytics, which uses cookies or other automatic tracking technologies to help us analyze how users interact with and use the Services, compile reports on activity, and provide other services related to activity and usage. 8. DO NOT TRACK SIGNALS

Some web browsers transmit “Do Not Track” (DNT) signals. Because there is no industry standard for how to respond to DNT signals, Joey Klein does not currently respond to DNT signals. However, where required by applicable law, Joey Klein will honor Global Privacy Control (GPC) or similar universal opt-out signals as a valid request to opt out of the sale or sharing of your personal information. You may also manage your cookie preferences through your browser settings or any cookie preference center we make available on the Site as described in Section 7.

9. CHILDREN’S PRIVACY

The Services are intended for a general audience and are not directed to children under the age of 13 (or such older age as may be required by applicable law). Joey Klein does not knowingly collect personal information from children under 13 (or such older age as may be required by applicable law). If you are a parent or guardian and believe your child has provided us with personal information, please contact us at admin@innermatrixsystems.com and we will take appropriate steps to address the matter.

10. THIRD-PARTY LINKS

The Site may contain links to third-party websites or services. Joey Klein is not responsible for the privacy practices of those third parties. We encourage you to review the privacy policies of any third-party sites you visit.

Joey Klein implements reasonable administrative, technical, and physical safeguards designed to protect the data it collects from unauthorized access, disclosure, alteration, or destruction. However, no method of data transmission or storage is completely secure, and Joey Klein cannot guarantee absolute security. In the event of a data breach affecting personal information, Joey Klein will comply with applicable breach notification laws.

12. INTERNATIONAL DATA TRANSFERS

Joey Klein is based in the United States and the information we collect is governed by U.S. law. If you are accessing the Services from outside the United States, please be aware that information may be transferred to, stored, and processed in the United States or other countries where our service providers are located, where data protection laws may differ from those in your jurisdiction. Where required by applicable law, Joey Klein will implement appropriate safeguards for such transfers, such as standard contractual clauses or other mechanisms recognized under applicable data protection laws. By using the Services, you understand that your information may be transferred to our facilities and to third parties with whom we share it as described in this Policy.

Joey Klein reserves the right to update or modify this Policy at any time. When we do, we will revise the “Last Updated” date at the top of this page. For material changes, we will provide notice by posting a prominent announcement on the Site and, where practicable, by sending an email to registered users. We encourage you to review this Policy periodically. Where required by applicable law, we will obtain your consent before implementing material changes that affect the processing of your personal information. Your continued use of the Services following updates, modifications, or changes constitutes your acknowledgment of the updated Privacy Policy.
